Residential Property EPC – Terms and Conditions

TERMS AND CONDITIONS FOR THE SUPPLY OF EPC SERVICES BY ZM STUDIO

DEFINITIONS AND INTERPRETATION

‘Booking’ means the order placed by the Client through submission of the Company’s Quotation, Contact and sales/shopping form(s) and agreed in written confirmation by the Company.

‘Client’ means the main client, reflected in the details provided in the Quotation.

‘Company’ means ZM Studio.

‘Quotation’ means the written quotation prepared by the Company which contains its proposals for providing Services to the Clients, this could be digitally provided.

‘Service’ means the service(s) the Company will provide to the Client as specified in the Order.

‘Specification’ means the description or specification of the Services in the Order.

‘Surveyor’ means the expert delegated to provide the Services to the Client.

‘Terms’ means these terms and conditions as updated from time to time by the Company.

Where these Terms use words in their singular form, they shall also be read to include the plural form of the word and vice versa. Where these Conditions use words which denote a particular gender, they shall be also read to include all genders and vice versa.

The headings in this document are inserted for convenience only and shall not affect the construction or interpretation of these Terms.

PROPERTY FLOOR PLAN QUOTATIONS

Where the Company has made every possible attempt to provide a quotation based on the information the Client has provided, the Company will honour that pricing. However in the event that the Company is provided additional requests not covered by the Quotation, additional charges will apply.

The Client shall be obliged as quickly as possible and prior to the Quotation expiry to comment on and or approve the Quotation to proceed to a formal booking.

A deposit up to the full value of the Quotation may be requested by the Company for large projects or where the Client is deemed high risk at the discretion of the Company.

PROPERTY FLOOR PLAN BOOKINGS

The Company will provide a booking confirmation via email on successful agreement of the Service to be provided by the Quotation. Verbal booking confirmations will be adhered to as best as reasonably possible but will be followed by a written booking confirmation.

PROPERTY FLOOR PLAN REFUNDS AND CANCELLATIONS

Cancellations of our floor plan services are possible in writing to the Company via Email and must be received in a timely matter to be processed. Verbal cancellations are not accepted.

Property Floor Plan bookings cancelled within 24 hours of the booking time are fully refunded, within 24-6 hours up to 50% of the agreed Booking will be charged as a fee, and from 6 hours to the booking time no refund is offered. Booking time is defined as the time in which the Services provided by the Company were to begin.

This fee may be waived on a successful rebooking but a deposit may be requested by the Company before the new Booking is confirmed.

In the event that the Quotation includes bundled or multiple services, please refer to the relevant terms and conditions.

PROPERTY PHOTOGRAPHY MEDIA

The Client shall receive the materials via an Internet file sharing website such as Dropbox or Google Drive. These materials will be restricted to a unique link which the Company and the Client agree to keep private. The Company holds no responsibility for the availability of these third party systems or the speed at which they operate. Physical copies are not provided unless specifically requested as part of the Quotation.

The Client agrees that the Floor Plan material provided by the Company is approximate measurements and should not be used for architectural plans.

The Company does not manipulate or edit floor plans, they must accurately reflect reality.

PROPERTY FLOOR PLAN PROCESS

Within the agreed time since of the competition of an on site survey, the floor plan(s) will be provided to the main contact as provided during the Quotation period unless otherwise requested by the Client in writing at least 24 hours prior to the work being carried out by the Company. In the event of no written statement on the time frame by the Company or the Client as part of the Quotation, the default is 24 hours.

The Client shall be obliged as quickly as possible and within the agreed deadline to confirm receipt of materials provided under the Services, so that a final invoice can be produced and paid within the agreed timeframe.

PROPERTY FLOOR PLAN ACCESS AND CONDITION

The Client must ensure that full access is provided to the Surveyor any area of the property that is locked or unsafe to access will be excluded with no refund.

The Client agrees for full access to be provided to the Surveyor at the agreed time in the Booking, if access is not granted after a grace period up to 15 minutes, additional charges will apply. After 30 minutes, the Booking is forfeit with a fee equal to the total cost of the Booking.

The Client agrees for the property to be in a clean and safe condition for the Surveyor. The Company will issue no refunds or changes due to poor condition of the property in the Booking. The Company and its Surveyor will not provide any tidying or cleaning services.

MISCELLANEOUS TERMS

The Company shall be not held accountable for any future changes to the property which are no longer reflected in the floor plan, or any legal disputes related to the floor plan and the data provided within.
